They say when you go in trade games you already have for money that only Utah and Florida can't. MY question is what are the laws against it and the reasoning behind it.

I am not 100% sure for Utah. I would have to research for that specific state. (And to be honest I'd rather not) But I can tell you why the trade-in program is not applicable in the state of Florida. (Utah and Florida are both unable to participate in the trade-in program)
The issue in Florida is the requirement for potential used game sellers to provide proper ID, a place of employment, physical description, and a thumb print before selling a copy of any game or game console. In addition, game stores/secondhand dealers must then hold the items for 15 days before attempting to resell them. I know this has become a big issue in Okaloosa County as it has become a "pet project" for the Sheriff's Department. Florida Statutes 538 and 539 were put into effect to stop the sale of stolen game paraphernalia. GameFly falls under the "secondhand dealer" portion of those statutes.
Since this is a state statute issue, I would suggest contacting your local state legislators.

Our apologies that the trade-in program is not currently available in your state. Below are the specific statutes that we have determined make it prohibitive to offer this program in Utah:
- Utah regarding "Secondhand Goods" § 13-32a-101 et seq.- Imposes record keeping, reporting, and holding requirements on businesses that deal in secondhand goods.
The legislation is often tracked on the EMA website: http://www.entertainmentmerchantsassociation.org/, so you can check this site for any future updates to these statutes. While these statutes do not make it illegal to offer a trade-in program such as ours in those states, they do impose additional requirements on the trade-in program that we are unable to comply with at this time.

The State Law in Utah requires them to track it much more thourough than they are able to do as a huge business. Sorry, but just to let you know gamestop gives better prices ;)
